In the report to the 20th National Congress of the Communist Party of China, General Secretary Xi Jinping laid out new plans for the comprehensive advancement of the rule of law. Today’s program focuses on “Upholding the Comprehensive Advancement of the Rule of Law and Promoting the Construction of a Country Ruled by Law,” inviting relevant experts to provide interpretations. The seventh part of the 20th National Congress report focuses on upholding the comprehensive advancement of the rule of law and promoting the construction of a country ruled by law. General Secretary Xi Jinping first pointed out in the report the great significance of the comprehensive advancement of the rule of law: the comprehensive advancement of the rule of law is a profound revolution in national governance, which concerns the Party’s governance and rejuvenation of the country, the happiness and well-being of the people, and the long-term stability of the Party and the country. Chen Yixin, Secretary-General of the Central Political and Legal Commission: The report to the 20th National Congress dedicates an entire chapter specifically to the construction of the rule of law, making special arrangements for it—a first in the history of our Party’s congresses. This fully demonstrates the high importance attached by the Party Central Committee with Comrade Xi Jinping at its core to the construction of the rule of law, and fully shows that our Party is not only one that dares to revolutionize, excels at construction, and is courageous in reforming, but also one that believes in the rule of law, adheres to it steadfastly, and builds it diligently. He Rong, Deputy Secretary of the Party Leadership Group and Executive Vice President of the Supreme People’s Court: The report specifically lays out strategic tasks for upholding the comprehensive advancement of the rule of law and promoting the construction of a country ruled by law, rallying broad consensus across the Party and the nation. It fully highlights that the rule of law is the fundamental approach to governing the country and administering state affairs, and an important underpinning of the national governance system and governance capacity, marking a milestone in the history of socialist rule of law construction in China. Since the 18th National Congress of the CPC, General Secretary Xi Jinping has positioned, planned, and enforced the rule of law from the overarching and strategic perspective of upholding and developing socialism with Chinese characteristics. He creatively proposed a series of new concepts, ideas, and strategies for the comprehensive advancement of the rule of law, forming Xi Jinping’s Thought on the Rule of Law—the most significant landmark achievement in the decade-long rule-of-law development of the new era. Chen Yixin, Secretary-General of the Central Political and Legal Commission: Xi Jinping’s Thought on the Rule of Law is the most comprehensive, systematic, and scientific legal thought system put forward by our Party over the past century. This thought has opened up new horizons in Marxist theory of the rule of law, expanded a new path for socialist rule of law with Chinese characteristics, endowed Chinese legal civilization with new connotations, and contributed new wisdom to safeguarding the international rule-of-law order. It is the most original contemporary Marxist theory of the rule of law in China. Xi Jinping’s Thought on the Rule of Law has propelled the construction of a country ruled by law to a new stage. To bring into full play the rule of law’s role in consolidating the foundations, stabilizing expectations, and benefiting the long term, we must comprehensively build a modern socialist country under the rule of law. The report further outlines the next steps and goals: We must adhere to the path of socialist rule of law with Chinese characteristics, build a socialist rule-of-law system with Chinese characteristics, and build a socialist country ruled by law. Shen Chunyao, Director of the Legislative Affairs Commission of the Standing Committee of the National People’s Congress: Building a socialist country ruled by law is one of our goals. Crucially, it is the socialist rule-of-law system with Chinese characteristics, which serves as the overarching framework for advancing the comprehensive rule of law. Specifically, this includes five sub-systems: a complete system of legal norms, an efficient system for implementing the rule of law, a rigorous system for supervising the rule of law, a robust system for guaranteeing the rule of law, and a perfected system of internal Party regulations—all of which encompass every aspect and field of the rule-of-law domain. The report to the 20th National Congress clearly defines the working layout for the comprehensive advancement of the rule of law as follows: Uphold the joint promotion of governing the country, administering the government, and conducting administration according to law; uphold the integrated construction of a country ruled by law, a government ruled by law, and a society ruled by law; and comprehensively advance scientific legislation, strict law enforcement, impartial justice, and universal compliance with the law. The report also specifically lays out work in four areas: perfecting the socialist legal system with Chinese characteristics centered on the Constitution, solidly promoting administrative governance according to law, strictly enforcing impartial justice, and accelerating the building of a law-based society. Chen Yixin, Secretary-General of the Central Political and Legal Commission: The seventh part of the report to the 20th National Congress, focusing on the new situation and new tasks of comprehensively building a modern socialist country under the rule of law, makes many new arrangements for rule-of-law development in the new era. Particularly regarding key aspects of the rule of law—scientific legislation, strict law enforcement, impartial justice, and universal compliance—it puts forward many new propositions and requirements, serving as an action guide that must be followed in the new era of rule-of-law development. The report proposes perfecting the socialist legal system with Chinese characteristics centered on the Constitution. After long-term efforts, China has established a socialist legal system with Chinese characteristics, and generally speaking, all aspects of state and social life now have laws to follow. Over the past decade of the new era, a number of urgently needed laws for national governance and essential for meeting the growing needs of the people for a better life have been successively introduced or amended—including the compilation of the Civil Code; the enactment and amendment of more than 20 laws such as the National Security Law and the Anti-Foreign Sanctions Law; and the enactment and amendment of laws like the Vaccine Administration Law and the Family Education Promotion Law, addressing prominent issues that concern the public through legal systems. To better leverage the leading and driving role of legislation, the report points out that we must strengthen legislative work in key areas, emerging areas, and foreign-related fields. Shen Chunyao, Director of the Legislative Affairs Commission of the Standing Committee of the National People’s Congress: These are important directions and key areas for legislative and regulatory work, matching and complementing our great cause of comprehensively building a modern socialist country and marching toward the second centenary goal. They include those areas that need to be strengthened, those that concern the people, and those that urgently require attention from all sectors. Emerging areas also present new legislative demands and topics as China’s economy and society rapidly develop and change. The third area is foreign-related fields. As China’s economic and social development deepens and its external exchanges become increasingly close—such as the Belt and Road Initiative and foreign economic, trade, and investment activities—relations are becoming ever closer. Therefore, foreign-related legislation is an area we must prioritize. The construction of a law-based government is a key task and major project in the comprehensive advancement of the rule of law. Only when the government takes the lead in administering according to law and acting according to law can the country develop orderly under the rule of law. The report points out that we must deepen the reform of the administrative law enforcement system, comprehensively promote strict, standardized, fair, and civilized law enforcement, intensify enforcement efforts in key areas closely related to the people’s immediate interests, improve administrative enforcement procedures, and refine standards for administrative discretion. Shen Chunyao, Director of the Legislative Affairs Commission of the Standing Committee of the National People’s Congress: The construction of a law-based government is a key task or major project in the comprehensive advancement of the rule of law and the building of a socialist country ruled by law. Among state organs at all levels, government agencies are the largest in size, employ the most personnel, and wield the greatest powers and public authority. Thus, whether they can achieve administration according to law and build a law-based government is of vital importance to the comprehensive advancement of the rule of law and the construction of a socialist country ruled by law. Impartial justice is the last line of defense for maintaining social fairness and justice. Since the 18th National Congress of the CPC, a number of historically wrongful convictions have been rectified one after another, and a series of top-level designs have woven a system of mechanisms for fairness and justice. The reform of the judicial staffing system has concentrated judicial resources on front-line case handling, and the reform of the judicial responsibility system has ensured that “those who hear cases make judgments, and those who make judgments take responsibility.” The socialist judicial system with Chinese characteristics is becoming more just, efficient, and authoritative. The report further emphasizes deepening the comprehensive and coordinated reform of the judicial system, fully and accurately implementing the judicial responsibility system, accelerating the building of a just, efficient, and authoritative socialist judicial system, and striving to ensure that the people feel fairness and justice in every judicial case. He Rong, Deputy Secretary of the Party Leadership Group and Executive Vice President of the Supreme People’s Court: The People’s Courts must continue to deepen the comprehensive and coordinated reform of the judicial system. On this issue, we must make great efforts to fully and accurately implement the judicial responsibility system, accelerate the establishment of a new mechanism for the operation of judicial power that is scientific, reasonable, standardized, and consistent with responsibilities, strengthen the restraint and supervision of judicial activities, deepen the construction of smart courts, and comprehensively advance the modernization of the trial system and trial capabilities. Putting the people at the center is the Party’s fundamental governing philosophy, and in judicial work, it is embodied as “justice for the people.” Cui Gan, a judge from Xiangtan County, Hunan Province, and a delegate to the 20th National Congress, deeply understands this. In 2016, an elderly man over 80 years old sued his son for failing to fulfill his duty of supporting him. Although the court ordered the son to pay alimony and closed the case, Cui Gan found that conflicts still existed between mother and son. He visited their home six times to mediate, eventually resolving the conflict. Cui Gan, Chief Judge of the Criminal Trial Division of the People’s Court of Xiangtan County, Hunan Province: I believe that the court, as the smallest unit of the court system and the closest to the people, should make good use of the weapon of rule-of-law protection provided by the court and serve the people with even greater sincerity and compassion. He Rong, Deputy Secretary of the Party Leadership Group and Executive Vice President of the Supreme People’s Court: As the People’s Courts, we will adjudicate cases in areas concerning people’s livelihoods—including education, healthcare, elderly care, childcare, and social security—in accordance with the law. We will strengthen the protection of the rights and interests of women, children, the elderly, and persons with disabilities, improve the long-term mechanism for solving difficulties in enforcement, enhance substantive resolution of disputes, and support the steady advancement of common prosperity. At the same time, we will expand and deepen the achievements of the “one-stop” diversified dispute resolution and litigation service system, safeguarding social fairness and justice and protecting people’s rights. A law-based society is the foundation for building a country ruled by law. How to ensure that all people believe in and practice the rule of law is a long-term, foundational undertaking. The report points out that we must carry forward the spirit of socialist rule of law and guide all people to be loyal advocates, conscious observers, and firm defenders of the socialist rule of law. Chen Yixin, Secretary-General of the Central Political and Legal Commission: Currently, the key to comprehensively advancing the rule of law is to ensure strict implementation of the law, turning the laws on paper into laws in action through law enforcement and judicial proceedings. As important functional departments responsible for implementing the law, political and legal organs must comprehensively promote strict, standardized, fair, and civilized law enforcement, intensify enforcement efforts in key areas closely related to the people’s immediate interests, and crack down firmly on serious illegal and criminal activities according to law, making urban and rural areas safer and the people happier. When the rule of law thrives, the country prospers; when the rule of law falters, the country falls into chaos. The report to the 20th National Congress of the CPC emphasizes that we must better leverage the rule of law’s role in consolidating the foundations, stabilizing expectations, and benefiting the long term, and comprehensively build a modern socialist country under the rule of law.The rule of law is a dynamic concept that encompasses not only the enactment of laws but also their implementation, oversight, and the public’s faith in the law. It represents the organic unity of legislation, law enforcement, judicial justice, and compliance with the law. By fully promoting scientific legislation, strict law enforcement, impartial judicial administration, and universal adherence to the law, we can weave a robust legal framework and strengthen the power of the rule of law. Only then can the cause of the Party and the state enjoy fundamental, holistic, and long-term institutional guarantees, ensuring that our society remains both vibrant and orderly amid profound transformations.
